Agreement for
ChineseFootMassage.com
And All Its Webpages
Before signing
up as an affiliate for FREE to sell any products by
ChineseFootMassage.com and all its webpages, you acknowledge that
you have read the terms and conditions, understand, and agree with
them.
1. Joining the Program
1.1
By filling out the signup form you will automatically become an
affiliate and are bound by the terms of this agreement.
1.2 Your participation in the program is
solely for this purpose: to legally advertise our website to receive
a commission on products purchased by your referral individuals.
1.3 Affiliate commissions are paid for each sale, based on the rates
offered for individual products. Current offered rate is 50% on the
price.
1.4 Payment of the commission will be on the
15th of the following month, with the condition that the total
commission earned is not less than US $50.00.
Example:
If a customer had bought through your link
on May 13, amounting US $49.97, your 50% commission amounting US
$24.99 will not be paid by June 15 because it is less than US $50.00
and the amount will be carried forward to June. You will receive a
notification e-mail if the payment is carried forward.
Let say, on May 24, another two customers
bought through your link amounting to US $99.94, and your 50%
commission is US $49.98. By June 15, your total commission earned is
US $74.97, and you will be paid this amount on June 15.
1.5 We pay our affiliates through Paypal. We
collect your paypal ID solely to facilitate payment only. We will
not use it for any other purposes, or reveal to any third party.
1.6 The payment will be made to you through
the Paypal ID you've supplied to us when you join in as our
affiliate. Thus, we are not responsible for any losses due to the
mistake, or wrong ID that you've provided. Please double confirm
that your Paypal ID is correct, or update it accordingly in your
affiliate areas if there's any changes for your Paypal ID.
1.7 The use of your Paypal account is
governed by the Term of Service between you and Paypal, and we are
not responsible for any problems of any nature arises from your
using of Paypal's service.
2.
Revocation of Affiliate Status
2.1
Your affiliate application and status in the
program may be suspended or terminated for any of the following
reasons:
a) Inappropriate advertisements (False claims, misleading
hyperlinks)
b) Spamming (mass email, mass
newsgroup posting, etc...)
c) Advertising on sites
containing/promoting illegal activities/Violation
of intellectual property rights.
3.
Affiliate Links
3.1
You may use graphic and text links both on your
website and in emails. The site may also be advertised "offline" in
classified ads, magazines, and newspapers.
3.2 You may use the graphics and text
provided to you by us, or you may create your own as long as they
are deemed appropriate according to the conditions in 2.
3.3 You will NOT earn
commissions on your own purchases - buying from your affiliate link
is not permitted and will simply not be compensated.
4.
Affiliate Tracking
4.1
When a web surfer clicks through your affiliate
link, a cookie is set in their browser that contains your affiliate
username. Also, their IP address is tracked in the database along
with your affiliate name for 12 months.
4.2 When this person decides to buy a
product, the script will look for this cookie and/or try to match
their IP address to identify the affiliate who will be awarded the
commission.
4.3 Visitors sent through your affiliate
link may make a purchase later in time and the commission will still
be awarded if the cookie is present in their browser and/or the are
using the same IP address as the one logged in the database.
4.4 The cookie will be valid for 12 years!
5. Terms
of the agreement
5.1 These terms will begin upon your signup with the affiliate
program and will end when your affiliate account is terminated.
5.2 The terms of this agreement may be
modified by us at any time. If any modification to the terms is
unacceptable to you, your only choice is to terminate your affiliate
account.
5.3 In Case-by-case basis, affiliate commission can be paid by using
other option such as check, demand draft or transfer, if the
affiliate are not able to accept commission via Paypal. Any charges
arises from using these other options will be paid by you, through
direct deduction from your total commission due.
5.4 We reserve the right to change the
payment method in the future. Your continuing participation in the
program will constitute your acceptance of any change.
5.5 The commission payout includes all taxes
that might apply in your country or state. If you have have to pay
or collect taxes for the payment, you have to deduct the amount for
the tax from the payout.
5.6 Affiliates are not allowed to use their
own affiliate link to purchase.
5.7 As the we offer 90-Days money back
guarantee, any request for refund from customer will be duly
obliged, and as such, your commission will be deducted accordingly.
5.8 Should the refund requested after your
commission is paid, the deduction will be made on current balance,
or on future sales, or we may proceed to request the refund from
you.
6.
Liability
6.1 We will not be liable for indirect or accidental damages (loss
of revenue, commissions) due to affiliate tracking failures, loss of
database files, and any results of "intents of harm" to the program
or our website.
6.2 We do not make any expressed or implied
warranties with respect to the affiliate program and/or products
sold at this site. We make no claim that the operation of the
affiliate program and our website will be error-free and we will not
be liable for any interruptions or errors.
6.3 Participant and ChineseFootMassage.com
(under K.P. Foot Reflexology Center) are independent contractors and
nothing in this agreement is intended to or will create any form of
partnership, joint venture, agency, franchise, sales representative
or employment relationship between the parties.
6.4 Participant shall not assign this
Agreement, by operation of law or otherwise, without the prior
written consent of ChineseFootMassage.com and K.P. Foot Reflexology
Center subject to the foregoing restriction, this agreement is
binding upon, insures to the benefit of and is enforceable by the
parties and their respective successors and assigns.
